Terms of Service

1. Agreement

By downloading, accessing, or using Gymvado, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Trader status & Google Play disclosures (EEA / UK)

Under Google Play’s global developer policies and applicable European Economic Area (EEA) and United Kingdom (UK) law (including the EU Digital Services Act framework as applied by Google Play), Izem Atlas LLC declares that it acts as a trader when offering Gymvado on Google Play — that is, as a legal person acting for purposes relating to its trade, business, craft, or profession (commercial publishing of software, including paid features, subscriptions, and/or advertising-supported experiences).

2.1 Trader identity & public contact details

The following trader details identify the provider of Gymvado and are the contact details intended for public display on Google Play where Google shows trader / App support information:

If Izem Atlas LLC maintains a D‑U‑N‑S number with Google Play organization verification, that number may also be shown by Google in the App support section of the store listing. Keep Play Console “About you” / payments-profile details aligned with the information above.

2.2 Self-certification of legal compliance

As required for traders on Google Play, Izem Atlas LLC self-certifies that it commits to offer only products and services that comply with the applicable laws of the countries and regions where Gymvado is made available on Google Play, including consumer-protection rules in the EEA and UK where trader disclosures apply.

2.3 What users may see on Google Play

Consistent with Google’s trader status guidance, when trader details are surfaced on Play (including phased display updates), users may see contact details, organization identifiers such as D‑U‑N‑S where applicable, and a link to these Terms of Service. In the EEA and UK, users may also see trader name / “Offered by” information and related compliance messaging as determined by Google Play.

2.4 Accuracy of declaration

Izem Atlas LLC is solely responsible for ensuring its trader declaration in Play Console remains accurate, truthful, and current. Misrepresenting trader status violates Google Play developer agreements and applicable unfair-commercial-practices rules.

3. The Service

Gymvado provides workout planning, logging, exercise demos, progress insights, and optional Pro membership features. Demo mode lets you explore on a device without an account. Signing in enables backup, membership, and trial features described in-app.

4. Not medical advice

Gymvado is a fitness utility, not a medical device and not medical advice. Training suggestions, loads, RIR guidance, and demos are general information. You are responsible for your health and form. Stop if you feel pain and consult a qualified professional when needed. Use equipment safely.

5. Accounts

You must provide accurate information when creating an account and keep credentials secure. You are responsible for activity under your account. We may suspend accounts that abuse the Service, attempt to circumvent billing, or violate these Terms.

6. Subscriptions, Free period & Pro trial

Gymvado Free and Pro features are described in-app. Store prices and renewals are charged by Google Play or the App Store under their terms. Manage or cancel subscriptions in the store account settings. Restore purchases re-reads store entitlements; it does not create a new charge by itself.

Where offered, a Free intro period and/or a one-time Pro trial per email may apply as shown in the app. Trials and Free periods may not be abused by creating duplicate accounts to reclaim the same benefit.

Consumers in the EEA/UK may have additional mandatory rights under local law (including withdrawal/cooling-off rules for distance contracts where they apply to digital content or services). Nothing in these Terms limits rights that cannot be waived under applicable consumer law.

7. Acceptable use

Do not reverse engineer, scrape, or disrupt the Service except as allowed by law.
Do not misuse sign-in, trials, or referrals to defraud Izem Atlas LLC or payment platforms.
Do not upload unlawful content or use the app for anything other than personal fitness tracking.

8. Intellectual property

Gymvado, its branding, UI, exercise media, and software are owned by Izem Atlas LLC or its licensors. You receive a personal, non-exclusive, non-transferable license to use the app as provided.

9. Third-party services

The Service may rely on third parties (for example authentication, analytics, crash reporting, ads, and subscriptions). Their terms and privacy practices apply to their processing.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, IZEM ATLAS LLC DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.

11. Limitation of liability

To the maximum extent permitted by law, Izem Atlas LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or training outcomes. Our aggregate liability for claims relating to the Service is limited to the greater of (a) amounts you paid us for Gymvado Pro in the 12 months before the claim or (b) USD $50. Some jurisdictions do not allow certain limitations; in those cases liability is limited to the fullest extent allowed. This section does not exclude liability that cannot be limited under mandatory consumer law.

12. Privacy

Personal data is handled as described in our Privacy Policy. Account deletion requests: Delete account.

13. Termination

You may stop using Gymvado at any time and request account deletion via Delete account. We may stop providing the Service or suspend access for violations, legal risk, or discontinuation with reasonable notice where required.

14. Changes

We may update these Terms. We will revise the “Last updated” date above. Continued use after changes become effective means you accept the revised Terms, except where additional consent is required by law.

15. Governing law

These Terms are governed by the laws of the State of Wyoming, USA, excluding conflict-of-law rules, without limiting mandatory consumer protections that apply in your country of residence (including in the EEA and UK).
